4. Account

Setting up an account is possible through the Website. You can log in using your Facebook or Google account, or by registering with another personal email and password.

It's crucial to provide accurate, complete and current information when creating your account. Failure to do so may result in the immediate termination of your account on both the Website and Service.

You are responsible for maintaining the confidentiality of your account and password. This includes, but is not limited to, restricting access to your device or mobile device and/or account.

You agree to take responsibility for any and all activities or actions that occur under your account and/or password. This holds true whether your password is associated with our Website and Service or a third-party service.

Should you become aware of any breach of security or unauthorised use of your account, it is your responsibility to notify us immediately.

When choosing a username, ensure that you do not use the name of another person or entity that is not lawfully available for use. Also, you may not use any name or trademark subject to rights of another person or entity other than yourself without appropriate authorisation. Usernames that are considered offensive, vulgar or obscene are also not permitted.

6. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or other promotions (collectively "Promotions") made available through the Service or Website may be governed by rules separate from these Terms and Conditions, particularly as outlined in the Agreement if applicable. Should you participate in any Promotions, please review the applicable rules and our Privacy Policy. In the event of a conflict between the rules of a Promotion and these Terms and Conditions, the Promotion rules shall prevail.

7. Subscriptions

Some portions of the Service are billed on a subscription basis ("Subscriptions"). Billing occurs in advance and takes place on a recurring, periodic basis, known as the "Billing Cycle." The Billing Cycle is set either monthly or annually, depending on the type of subscription plan you select. Unless you or the Company cancels the Subscription, it will automatically renew under the same conditions at the end of each Billing Cycle.

You may cancel your Subscription either through your Account or by contacting the Company’s customer support at support@. A valid payment method, such as a credit or debit card, Apple Pay, or Google Pay, is required to process the subscription payment.

You are required to provide accurate and complete billing information. This includes:

Submitting these payment details authorises the Company to charge all Subscription fees via your Account.

If automatic billing fails for any reason, an electronic invoice will be issued. This invoice will specify that manual payment must be made by a certain deadline.

We reserve the right to refuse or cancel your order for reasons that may include but are not limited to service availability, errors in pricing or description, or suspected fraud or unauthorised or illegal transactions. Additional fees or taxes imposed by the relevant authorities in your jurisdiction are not the responsibility of the Company.

8. Fee Changes

The Company reserves the right to modify Subscription fees at its sole discretion. Any Subscription fee changes will take effect at the conclusion of the current Billing Cycle. Reasonable prior notice of any change in Subscription fees will be given, offering you the opportunity to terminate your Subscription before the change takes effect. Continued use of the Service after a Subscription fee change implies consent to the new fee structure.

9. Refunds

Unless required by applicable law, paid Subscription fees are non-refundable.

10. Content

Our Service and Website allow you to post, link, store, share, and otherwise make available specific information, text, graphics, videos, or other material ("Content"). You bear responsibility, particularly towards your customers, for the Content you post through the Service, including its legality, reliability, and appropriateness.

By posting Content through the Service or Website, you represent and warrant that:

(i) the Content is yours or you have the right to use it, and (ii) you have the right to grant us the rights and licence as stipulated in these Terms and Conditions.

13. Intellectual Property

The Service, the Website, and their original content (excluding user-generated Content), features, and functionality are and shall remain the sole property of Support AI and its licensors. They are protected by copyright, trademark, and other laws both in the United Kingdom and other countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

The User does not acquire any rights to the Intellectual Property by using the Service. Any use of the Intellectual Property for purposes other than those permitted under Article 23 of the Act of 4 February 1994 on Copyright and Related Rights is prohibited. Upon purchase of a Subscription, the User is granted a limited, non-transferable, revocable, and non-exclusive License to use the Service in compliance with the Subscription terms.

The User may not modify, reverse engineer, decompile, or attempt to derive the source code from the Service or Website. Automated or proxy access to the Service or Website is also prohibited.

We respect the intellectual property rights of others. It is our policy to respond to any claim that user-generated Content on the Service or Website infringes the copyright or other intellectual property rights ("Infringement") of any person or entity. Support AI makes no representations or warranties of any kind, express or implied, as to the operation of the Services, or the information, content, or materials included therein. You expressly agree that your use of the Services, their content, and any services or items obtained from us is at your sole risk.

19. Limitation of Liability

Support AI shall not be liable for any indirect, punitive, special, incidental, or consequential damages, however arising, whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this Agreement, including without limitation any claim for personal injury or property damage.

20. The Guest’s/User’s Liability

The Guest and/or User is fully liable for the consequences of authorised or unauthorised distribution of any content available on the Website or the Service. This applies particularly to Intellectual Property. The liability includes, in particular, Support AI's release from any claims in this respect if such claims are made against Support AI.

21. Service Breaks

Support AI does not guarantee the permanent accessibility of the Service or the Website. If there is an intention to implement a break, Support AI will notify users by posting relevant information or a message on the Website or via the email provided during the Account setup process at least 3 days before the planned break.

22. Personal Data Protection and Security

Support AI processes personal data with due diligence and ensures adequate technical and organisational security measures. Support AI shall not be liable for the personal data protection of the User's customers who use the Service.

23. Termination

We may terminate or suspend your Account and deny access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

24. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

25. Changes to Service

We reserve the right to withdraw, suspend, or amend our Service and any service or material we provide via the Service, at our sole discretion. We will make reasonable efforts to notify you in advance. We shall not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. We may also restrict access to some parts of the Service or the entire Service to users, including registered users, in compliance with UK law.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent so that the remaining provisions of these Terms continue in full force and effect, in compliance with UK law.
